Nampa man, 28, charged with felony for sex with girl younger than 16

David Michael Arquette is being held in the Canyon County Jail on a charge of lewd conduct after he allegedly impregnated a girl whose family he had befriended.

The girl, whose age was redacted from court documents, told Nampa police the unprotected sex was consensual and that Arquette made her tell everyone she was 19 although she was younger than 16. Arquette told police he knew the girl's true age, but he gave her an engagement ring and he was happy when he learned she was pregnant, according to a probable cause affidavit.

"To prevent him from getting in trouble they came up with a story that she had met a boy she didn't know, had sex, and the condom broke," according to the affidavit account of Arquette's interview with police.

Arquette was arrested Friday and arraigned Monday on the felony charge. His bond is set at $200,000, and a preliminary hearing is scheduled for Feb. 12.
