Ex-Idaho teacher pleads guilty to lewd conduct with student, child enticement
An ex-Idaho teacher was expected to stand trial Tuesday for allegations he committed “lewd” and “lascivious” acts with a then-15-year-old student. Instead, the Emmett teacher pleaded guilty to two felonies the day before.
Former Black Canyon High School teacher Dustin Kisner pleaded guilty Monday to lewd conduct with a child under 16 years old and enticing a child through the internet, video image or another communication device, according to online court records. Kisner is no longer an employee of the Emmett School District as of Feb. 21, the district previously told the Idaho Statesman.
Sometime between December 2021 and January 2022, Kisner had “sexual intercourse” with the student, according to an amended information document filed by the Gem County Prosecutor’s Office. He also used the internet to “solicit, lure, persuade, or entice” the student, the document said.
He was initially charged with two counts of lewd conduct — which can carry a stricter prison sentence — but pleaded guilty to one count of child enticement to replace one of the lewd conduct counts as part of a plea agreement with the Gem County Prosecutor’s Office, according to court documents. The Statesman reached out to the prosecutor’s office for additional information.
As a part of the plea agreement, the prosecutor’s office is expected to recommend Kisner spend at least four years in prison and another eight on parole, in prison or a combination of the two. Under Idaho law, Kisner could face up to life in prison for the lewd conduct count and up to 15 years for the enticement count.
He is expected to be sentenced at 10 a.m. Nov. 14 at the Gem County Courthouse, court records showed.
Kisner previously worked with the Boise School District from August 2011 to January 2017, district spokesperson Dan Hollar previously told the Statesman.
Kisner’s lawyer, James Keith Ball, did not immediately respond to a request for comment Tuesday.
