Former Boise State football player Timothy Gilligan pleads guilty to burglary

The former BSU football player and prison officer was originally accused of sexual contact with a female inmate.

Timothy Ryan Gilligan will not have to register as a sex offender after a deal with the Ada County Prosecutor's Office allowed him to plead guilty to a lesser charge you might not expect.

The former officer with the Idaho Department of Correction was originally charged with two counts of having sexual contact with a female inmate in 2007.

But on Tuesday, he pleaded guilty to a new charge: burglary - a crime technically committed when someone enters a building with the intent to commit a felony.

Gilligan admitted to 4th District Judge Ronald Wilper that he twice entered the Idaho Maximum Security Institution with the intent of having sexual contact with a female inmate.

Jon Cox, Gilligan's attorney, told Wilper that prosecutors agreed to reduce the charge to burglary after Gilligan completed a psychosexual evaluation at SANE solutions, but did not say what the results of that evaluation entailed.

The charge of burglary is punishable by up to 10 years in prison. There is no agreement on the length of sentence between prosecutors and Gilligan's attorney. A sentencing hearing is scheduled for Oct. 20 at 3 p.m.

Last December, a female inmate told an IDOC employee about a series of incidents that occurred in April 2007, when she was on some kind of inmate worker program.

She told investigators she had sexual contact with Gilligan three times in 2007 at an IDOC facility.

Female offenders from South Boise Women's Correctional Center, a minimum security facility, sometimes do janitorial work at the maximum security prison.

Gilligan, a 28-year-old Boise resident, was a wide receiver for the Boise State football team between 2000 and 2003 and also played for a short period of time in the Canadian Football League.
