Boise moves to shut down Torch 2 bikini bar

The Vista Avenue bikini bar's right to operate was revoked because of zoning code violations.

City planning officials say an entrance room to the building was expanded without approval or permits.

Boise's zoning code does not allow bikini bars within 300 feet of residential areas. But the bar predates the ordinance, which was enacted in 2002, so it has been allowed to continue to operate. The city can revoke grandfather rights if a business illegally expands.

In 2007, Torch 2 owner Mans Montgomery asked the city for permission to expand his business and make other improvements. The city turned down most of his requests, but he was allowed to make the bathrooms handicapped-accessible.

Montgomery claims he's abiding by the city's rules. He said he was out of town when "friends" he'd hired to tear off old roofing found dry rot in the existing covered entry and rebuilt and enlarged it without his permission.

The structure has been torn down, Montgomery said Thursday afternoon.

"There is no way I am risking my business by gaining a couple feet in my entryway," Montgomery said. "I think it is wrong the city is trying to revoke my grandfather rights."

Montgomery should have known better given his history with the city and the corrective steps he's had to take in the past, officials said in a press release.

Montgomery said he plans to appeal the decision with the Planning and Zoning Commission. The business will continue to operate during the appeals process.

Neighbors have complained that parking spills onto residential streets and that lingering bar patrons create noise and litter.
