Oregon men arrested after downtown brawl

September 30, 2013

— Two Ontario men are facing multiple charges after a fight in downtown Boise in the early hours of Sunday morning.

Witnesses told officers they saw 26-year-old David Manuel Avila and 30-year-old Francisco Andres Avila hitting a woman, and stepped in to stop them.

But when they tried to intercede, a brawl broke out between the Avilas and the witnesses, police said. One man suffered a laceration on his face and other injuries in the fight, police said.

When an officer searched David Avila for weapons, he allegedly intentionally blew blood and mucus out of his nose onto the officer’s face and body. When the officer warned him not to do it again, he repeated the action, police said.

Both David and Francisco Avila were arrested and booked into the Ada County Jail.

David Avila was charged with felony aggravated battery, felony battery on an officer, and three counts of misdemeanor battery. Francisco Avila was charged with aggravated battery and three counts of misdemeanor battery.

They are scheduled to appear in court Monday afternoon.
