Suspect bound over in accidental shooting case

September 24, 2013

Derick Lee Sedivy

— Derick Lee Sedivy, 23, waived a preliminary hearing Monday and was bound over to Fourth District Ada County Court.

Sedivy was charged with involuntary manslaughter after police said he shot his cousin, Austin Blankenburg Cummins, 20, on May 10. Authorities said the shooting appeared to be an accident.

Cummins, a Kuna resident, died from his injuries. Police said alcohol may have been a factor in the shooting.

Sedivy pleaded not guilty on May 15. He posted $50,000 in bond and has been free since May 14.

If convicted, Sedivy could face up to 10 years in prison on the manslaughter charge. He could receive an additional 15 years if he is found to have used a deadly weapon in the commission of the manslaughter.

He is scheduled to be arraigned Oct. 9 before Judge Cheri Copsey.
