Boise man arrested for DUI, injury to child

May 21, 2013

A man who police say was driving drunk with his young child in the car Saturday has been charged with a DUI and felony injury to a child.

Mark Jason Day, 34, was pulled over for a traffic violation when the officer noticed that he appeared to be intoxicated. A child under the age of 10 was also in the vehicle, police said.

Day failed several field sobriety tests, and had a blood alcohol content of .23/.22 at the Ada County Jail. He has three prior DUI convictions, making the charge a felony.

He was booked into the Ada County Jail Saturday afternoon.

If convicted, Day faces one year to ten years in prison for the injury to a child charge, and 30 days to five years in prison for the felony DUI charge.
