Garden City repeals new Greenbelt ordinance

Published: November 27, 2012

What about the will of the voters? More than 52 percent of Garden City voters said Nov. 6 that they didn’t want to see the city restrict non-motorized uses of the Greenbelt, unless restrictions are ratified by the public in a vote. But city officials say the ordinance created through Initiative B denies the city regulatory authority granted by the Idaho Constitution. In a unanimous 4-0 vote Monday, the City Council voided the ordinance.

One initiative passed, one failed: Voters turned down another initiative — Initiative A — which would have repealed the city code that allows a ban on bicycles on a 1.5-mile Nature Path.

Amend it, don’t repeal it: That’s what initiative proponent Alan Greer asked the City Council to consider. The Garden City resident, who works as a store manager, said he knocked on 1,000 doors to gather signatures for the initiative petitions. “To just flat say, ‘We’re going to repeal it,’ after the voters have approved it, there’s no reason to do that. If they want to change some wording, we’re all for that,” Greer said before the council meeting.
