Judge denies Bujak motion to disqualify prosecutor; defense files contempt motion in separate case

Two new developments arose Friday in the felony case against former Canyon County Prosecutor John Bujak, who is accused of illegally taking $236,000 in public funds from a Nampa prosecution contract. Senior District Judge G.D. Carey denied Bujak’s motion to disqualify Stephen Bywater, who is co-counsel to Special Prosecutor Bill Thompson. Bujak sought that action because, he said, Bywater had prior information related to the case because Bujak had contacted Bywater about the Nampa contract while Bujak was county prosecutor. Also on Friday, Bujak defense attorney Nancy Callahan filed a motion seeking a contempt citation against Deputy Canyon County Prosecutor Michael Porter, stating that Porter obstructed defense attempts to access evidence. A hearing on the contempt motion is set for next Friday.
