Brian R. McGraw watched another man shoot his cousin inside a room at a West Fairview Avenue room shortly after 11:30 p.m. Saturday, his public defender said. The 21-year-old McGraw is charged with a felony count of possessing marijuana with intent to deliver after Boise police say he was caught walking away from the scene of the shooting Saturday carrying about three ounces (88 grams) of pot.
Police say they found digital scales and an additional 1.5 ounces of pot in McGraws motel room, packaged for sale in multiple baggies. Ada County prosecutors say McGraw told police he had been selling about 7 to 8 ounces of pot a week.
Police have declined to identify the shooting victim who McGraw said was his cousin.
They do say detectives have been following several leads in connection with the shooting but have not yet publicly identified a suspect or made an arrest. They have not released any information on a motive for the shooting and have declined to say if they suspect it was connected to McGraws drug arrest.
During McGraws initial court appearance Monday, his lawyer didnt make any connection either, saying only that McGraw insists the shooting was part of a robbery without explaining why his cousin was a target.
McGraws lawyer also said the man who was shot was in critical condition at a local hospital Monday. Boise police said Sunday it appeared his injuries were not life-threatening.
Ada County prosecutors asked a judge for a $100,000 bond for McGraw, but 4th District Magistrate Theresa Gardunia issued a $10,000 bond at the request of his attorney.
McGraw said Monday he would be able to post bond, but was still in jail early Tuesday afternoon. In addition to the drug charge, he is being held on misdemeanor charges of failure to appear and probation violation.
