A 21-year-old California man is being held in the Ada County Jail on $200,000 bond after Garden City police say he had sex with a 16-year-old girl several times earlier this year and then left town earlier this summer.

Marshall Townsend Webster is charged with felony counts of rape and possession of sexually exploitative materials and a misdemeanor count of disseminating materials harmful to minors.

Ada County prosecutors said Wednesday Webster had naked pictures of the girl, which led to the possession charge, and sent her pictures of his genitalia, which led to the misdemeanor.

A preliminary hearing on the case is set for Aug. 1.

While it is unclear when Garden City Police began investigating the case, Ada County prosecutors issued an arrest warrant for Webster on June. 28.

It appears as if police in San Luis Obispo arrested Webster on the Idaho warrant and shipped him back to Ada County, where he was booked into jail Wednesday.

The case is not being charged as a forcible rape. Ada County prosecutors say Webster admitted having a sexual relationship with the teen between April and June of this year. The case is charged as rape because the girl is 16 and Webster is more than three years older than her, according to Idaho code.

The crime of rape is punishable by up to life in prison. Anyone convicted of rape would have to register as a sex offender in the state of Idaho.
