Boise police: 35-year-old man charged with DUI Saturday night had five pre-teen kids in car

Cory B. Ashbaker is charged with misdemeanor counts of excessive DUI and injury to child after Boise police say he was driving drunk on Saturday night with five kids in the car with him.

The children were between the ages of 8 and 11, according to Boise police. Officer say the 35-year-old Ashbaker registered a .222 blood alcohol content percentage after taking a breath test at the Ada County Jail, which is just under three times the legal bac limit of .08 in Idaho.

Boise police pulled over Ashbaker around 11 p.m. Saturday after an officer saw Ashbaker driving a Honda Accord with a flat tire while making a wide turn off North Maple Grove Road on to Goddard Road, according to reports.

Officers say they smelled a strong odor of alcohol coming from Ashbaker during the traffic stop and say he failed field sobriety tests before they took him to the jail. Police reports don’t indicate where Ashbaker and the kids were going when he was pulled over.

Ashbaker was released from jail after posting bond. He is scheduled to make his initial court appearance Wednesday.

Boise police arrested Ashbaker on a DUI in May 2007. Idaho court records show Ashbaker entered a guilty plea in connection with that case and was given a withheld judgement.
