'Worst case of elder abuse' in 10 years

Nampa twins, 55, are jailed on felony charges of neglecting their bedridden mother.

The scene police found in the 92-year-old woman's bedroom was horrendous.

"She had open sores in her back, her spine was exposed, and there were maggots in the wounds," Canyon County Prosecutor John Bujak said Monday. "It's terrible É the worst case of elder abuse I've ever seen in 10 years in Canyon County."

Her sons, 55-year-old twins Danny and David Nicks, could face up to 10 years in prison and a $25,000 fine if convicted on charges of felony abuse or neglect of a vulnerable adult. They were arraigned Monday and are being held in the Canyon County jail.

Verda Nicks died Dec. 26, about six weeks after she was rescued from her garbage- and feces-filled home. The cause of death is listed as natural, and unless evidence establishes that her death was caused by neglect, the brothers will not be charged with causing her death, Bujak said.

Police went to the home on 7th Avenue South to check on Verda Nicks on Nov. 17 after a friend called to report she had been unable to reach the woman by phone for several weeks, according to court documents.

The twins weren't charged immediately because it wasn't clear they were legally responsible for their mother, Bujak said, noting that Verda Nicks said no one was taking care of her.

But later, prosecutors learned the brothers were serving as her caretakers and filed felony charges Dec. 16. Magistrate Judge Gregory Frates dismissed the charges Dec. 31, saying a doctor needs to confirm Nicks' injuries were caused by her sons' actions. Prosecutors refiled the charges later that day, Bujak said, adding he is confident they will be able to establish the necessary link between the sons' behavior and their mother's condition.

A doctor told police Verda Nicks was "extremely thin, clinically dehydrated and would need extensive wound care for the open sores on her back," according to court documents.

The brothers told police their mother had been bedridden for about two years since breaking her hip for the second time. The first time, she went into a nursing home, and she did not want to return, David Nicks said.

Danny Nicks told police the brothers had lived in a camp trailer on their mother's property since 2003 and used her Social Security checks to pay rent and other expenses.

David Nicks told investigators it had been about a year since his mother had a shower, but she was "responsible for cleaning herself." Danny Nicks told investigators the brothers fed their mother one "good" meal a day, such as fried chicken or liver and onions. When police asked about the hundreds of dog food cans in the home, Danny said his brother was responsible for all housecleaning.
