Boise State sues Fred Meyer for selling unauthorized blue and orange T-shirts

Boise State University has filed a federal lawsuit against Fred Meyer, claiming trademark infringement because the store is selling unauthorized T-shirts.

Fred Meyer is selling blue-and-orange T-shirts reading “Buck the Ducks” and “Duck Season” with the date “September 3, 2009.”

The Boise State Broncos take on the University of Oregon Ducks on Sept. 3.

According to Boise State, even though the school's name never appears, “the T-shirt design is carefully crafted to conjure and trade on the reputation and goodwill of the University.”
