A 48-year-old Nampa man charged with murdering his stepson on Christmas night must wait two weeks before he finds out whether he will be bound over to district court on the felony charge.
James Robert Malec was scheduled for a preliminary hearing Thursday, but it was rescheduled for Jan. 22 so attorneys would have time to peruse more than 200 pages of discovery (pre-trial disclosure of documents) that Chief Deputy Criminal Prosecutor Virginia Bond said her office received Wednesday.
Malec, clad in prison orange, entered the courtroom briefly to agree to the continuance. He is being held on a $1 million bond on a charge of second-degree murder in the shooting death of Justin Mark Eilers, 30, during a family gathering Dec. 25 at Malec's home on Happy Valley Road.
Eilers, a nationally known mixed martial arts fighter, was reportedly arguing with Malec before the shooting. Both men had been drinking that night, according to reports.
Malec is a former jail deputy and dog handler for the Canyon County Sheriff's Office.
